Partner Terms and Conditions

These partner terms and conditions (“Agreement”) govern your participation in the Elegant Memorials Partner Program (“Program”). Please read these partner terms carefully before applying.
1. Partner Terms Overview
The Elegant Memorials Partner Program allows approved partners to earn commissions by referring customers and selling memorial plaques and related services. Partners may include funeral homes, cemeteries, memorial service providers, and other approved businesses or individuals.
2. Eligibility and Application
To participate in the Program, you must:
- Be at least 18 years of age
- Provide accurate and complete information during the verification process
- Have a valid Canadian Social Insurance Number (SIN) or Business Number for tax reporting purposes
- Maintain an active bank account, PayPal account, or accept Interac e-Transfer for commission payments
- Comply with all applicable laws and regulations
Elegant Memorials reserves the right to accept or reject any application at its sole discretion.
3. Partner Verification
All partners must complete our verification process, which includes providing government-issued identification, business documentation (if applicable), and banking information for commission payouts. This information is collected solely for identity verification and tax reporting purposes and is protected using bank-level encryption.
4. Commission Structure
4.1 Commission Rates
Commission rates vary based on your partner tier and are specified in your partner dashboard. Rates may include commissions on initial plaque sales, subscription activations, and/or recurring subscription renewals.
4.2 Commission Eligibility
Commissions are earned when a referred customer completes a qualifying purchase. A referral is attributed to your account when the customer uses your unique partner link or partner code.
4.3 Commission Approval
Commissions are subject to a review period to account for refunds, chargebacks, and order cancellations. Commissions become approved after the review period has passed and the transaction is confirmed as valid.
5. Payouts
5.1 Payout Schedule
Approved commissions are paid quarterly according to the following schedule:
- Q1 (January–March): Paid in April
- Q2 (April–June): Paid in July
- Q3 (July–September): Paid in October
- Q4 (October–December): Paid in January
5.2 Minimum Payout Threshold
Payouts are processed when your approved commission balance meets the minimum threshold you selected during verification (default $50 CAD). If your balance does not meet the threshold, it will roll over to the next payout period.
5.3 Payout Methods
Commissions are paid via your selected payout method: PayPal, Interac e-Transfer, direct deposit, or cheque. You are responsible for ensuring your payout information is accurate and up to date.
6. Tax Obligations
6.1 Tax Reporting
Elegant Memorials will issue a T4A slip for commission payments totaling $500 or more in a calendar year, as required by the Canada Revenue Agency (CRA).
6.2 Your Responsibility
You are solely responsible for reporting and remitting any taxes owed on commission income. Elegant Memorials does not provide tax advice, and we recommend consulting a tax professional regarding your obligations.
7. Partner Conduct
As a partner, you agree to:
- Represent Elegant Memorials and our products accurately and professionally
- Not make false or misleading claims about our products or services
- Not engage in spam, unsolicited communications, or deceptive marketing practices
- Not bid on Elegant Memorials branded keywords in paid advertising without prior written approval
- Comply with all applicable advertising laws and regulations, including disclosure requirements for affiliate relationships
- Not engage in any activity that could harm Elegant Memorials’ reputation or business
8. Intellectual Property
Elegant Memorials grants you a limited, non-exclusive, revocable license to use our approved marketing materials, logos, and trademarks solely for promoting our products as part of the Program. You may not modify these materials without prior written consent.
9. Confidentiality
You agree to keep confidential any non-public information disclosed to you as part of the Program, including commission rates, business strategies, and customer information. This obligation survives termination of this Agreement.
10. Agreement Duration and Termination
10.1 Term
This Agreement begins when your partner application is approved and continues until terminated by either party.
10.2 Termination
Either party may terminate this Agreement at any time with written notice. Elegant Memorials may immediately terminate your participation if you breach any term of this Agreement.
10.3 Effect of Termination
Upon termination:
- Your access to the Partner Dashboard will be revoked
- Pending commissions that have been approved will be paid according to the regular payout schedule
- Unapproved commissions may be forfeited at Elegant Memorials’ discretion
- You must immediately cease using Elegant Memorials’ trademarks and marketing materials
11. Limitation of Liability
To the maximum extent permitted by law, Elegant Memorials shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your participation in the Program.
12. Indemnification
You agree to indemnify and hold harmless Elegant Memorials, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your breach of this Agreement or your participation in the Program.
13. Modifications to Partner Terms
Elegant Memorials reserves the right to modify these partner terms, commission rates, or any aspect of the Program at any time. We will notify you of material changes via email or through your Partner Dashboard. Continued participation in the Program after such notification constitutes acceptance of the modified terms.
14. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
15. Entire Agreement
This Agreement constitutes the entire agreement between you and Elegant Memorials regarding the Program and supersedes all prior agreements and understandings.
